Media Reports on Court Certifying Class in Kent School Student Privacy Case

CT Insider, the Connecticut Law Tribune and Law360 reported on a significant class certification ruling in Silver Golub & Teitell's lawsuit against Kent School, a private boarding school in Kent, Conn., over allegations that a former IT employee spent years accessing students' private photos and files.

Waterbury Superior Court Judge Daniel J. Klau certified the case as a class action, allowing current and former Kent School students to collectively pursue claims that the school was negligent, acted recklessly, and violated the Connecticut Unfair Trade Practices Act by failing to protect their personal data and adequately supervise IT employee Daniel Clery. The court also appointed Silver Golub & Teitell as co-lead class counsel.

SGT partner Jennifer Sclar, who argued the motion for class certification, said the ruling ensures accountability for every affected student: "The court's decision allowing this action to move forward on a class basis will ensure that every student who had their private and sensitive photos and information stolen by Daniel Clery will be able to seek accountability from Kent School for its negligence and recklessness in allowing Clery to operate with little to no supervision and with inadequate computer safety protocols for almost a decade," she told the publications.

Clery, who served as the school's network and systems administrator for approximately 23 years, was arrested in 2024 and charged with two counts of first-degree computer crimes after investigators found thousands of sensitive photographs and videos, in many instances of minor children, on his home devices.
