Death of Baby Leads to Filing of Wrongful Death Lawsuit Against Women’s Health Care of New England

NORWALK, CT (November 27, 2018) – As a result of the preventable death of their baby boy, Zayn Botero-Choudhry, Maritza Botero and her husband, Naveed Choudhry, have filed a lawsuit against Women’s Health Care of New England, P.C., in Norwalk, CT, and Maryam Hedayatzadeh, M.D. The lawsuit asserts that Mrs. Botero was almost thirty-nine weeks pregnant when she saw Dr. Hedayatzadeh and had clear symptoms of intrahepatic cholestasis of pregnancy (“ICP”) – a liver disease which increases the risk of fetal distress and death. The lawsuit asserts that Zayn, who was a healthy full-term baby at that time, should have been promptly delivered. Instead, defendants ordered additional tests and did not take any steps to closely monitor Zayn’s health. When the test results confirmed the diagnosis of ICP, the lawsuit claims, they were not reported to the patient for several days – due to a holiday weekend. By that time, Zayn Botero-Choudhry had died.

The civil wrongful death lawsuit is being handled by attorney Peter M. Dreyer of the Connecticut law firm Silver Golub & Teitell LLP. Attorney Dreyer also brought a 2017 wrongful death lawsuit for the death of a baby at Greenwich Hospital against Dr. Hedayatzadeh’s twin sister, Marjan Hedayatzadeh, M.D. That case was captioned Lauren E. Sorgen and Grant D. Gulyassy as Co-Administrators of the Estate of Myriam Grace Gulyassy v. Greenwich Hospital, Marjan Hedayatzadeh, M.D. et al. (Docket No. FST-CV-17-6030787-S).

“Sadly, we cannot change what happened to Zayn,” said Mr. Dreyer, “but we can hope that this lawsuit will help make the public aware of the dangers of ICP. This family went to Women’s Health Care of New England and Dr. Hedayatzadeh because they believed they would receive exceptional medical care. They now feel their trust in these healthcare providers was misplaced and suffer daily from the pain of the loss of their son.”
