SEBAC CLASS ACTION STATUS REPORT

We have a new toll-free telephone number — (844) 701-0008.

We have identified approximately 2,700 class members entitled to recover economic damages as a result of the Rowland layoffs and demotions and have reached full or partial settlements for nearly all of these class members.  We have been unable to locate or obtain a response from a small number of individuals likely entitled to economic damages under the settlement.  Please click here to see the list of individuals we have not been able to reach. If your name is on the list please contact us as soon as possible.  If you recognize someone else’s name on the list and can help us reach that person, please contact us or have that person contact us.

For those class members who have received economic damages awards, we are working with the Retirement Services Division of the State of Connecticut to correct any pension impact that may have resulted, consistent with the class member’s award for economic losses.  For those class members with pension impact, please be sure to update us with any changes to your contact information.

THE SETTLEMENT

Under the Settlement, individuals who were employed by the State of Connecticut and a member of a bargaining unit (or designated for membership in a bargaining unit upon completion of a test period or other provisional appointment) as of November 17, 2002 are eligible for compensation.

If you were laid off and re-hired within one year, laid off for more than one year, or laid off and not rehired:

Most class members who were laid off and rehired within one year, laid off for more than one year, or laid off and not rehired have already received an award for economic losses.  If you have not received an award and believe you are entitled to one, please contact us immediately.

You should already have received an award for emotional distress damages. If you were employed by the State of Connecticut at the end of 2015, you should have received an award of 80 vacation hours and 40 personal leave hours. If you were not still employed by the State at that time, or if your job with the State was not eligible for vacation or personal leave, you should have received a payment of $750 (as the first half of a total award of $1,500) in October 2015 and a second payment in approximately October 2016. If you have not received either the vacation and personal leave credit (for active State employees) or one or both of the payments of $750 (for all others), please contact our office immediately.

If you were demoted or suffered other forms of economic loss compensable under the Settlement Agreement:

Most class members who were demoted or suffered other forms of economic loss compensable under the Settlement Agreement have already received an award for economic losses.  Please click here to read the Settlement Agreement provisions regarding losses covered under the Settlement, including, for example, expenses from increased mileage in excess of 25 miles one way and payment for health insurance premiums.  If you have not received an award and believe you suffered compensable losses under the Settlement Agreement, please contact us immediately. 

You should already have received an award for emotional distress damages. If you were still employed by the State of Connecticut at the end of 2015, you should have received an award of 32 vacation hours and 24 personal leave hours. If you were not still employed by the State, or if your job with the State was not eligible for vacation or personal leave, you should have received two payments of $350 (the first in October 2015, the second in approximately October 2016).

If you believe that you were made to retire as a result of the layoffs:

Most class members who suffered an involuntary retirement have already received an award for economic losses. If you have not received an award and believe you were forced to retire as a result of the layoffs, please contact us immediately.
